Terms of Service

These terms are the agreement between you and Launch ("Launch", "we", "us") for your use of the website builder at getlaunchednow.com and the sites you create with it (the "Service"). By creating an account or using the Service, you agree to these terms. If you are using Launch on behalf of a campaign, committee, or organization, you are agreeing on its behalf and you confirm that you have the authority to do so.

1. Who can use Launch

You must be at least 18 years old. Launch is open to candidates, committees, and organizations of any party or none. We may decline or end service to anyone who breaks these terms.

2. Your account

You are responsible for what happens under your account and for keeping access to the email or Google account you sign in with. Tell us at support@getlaunchednow.com if you believe someone else has gained access.

3. Your content

You own the text, images, and other material you put on your sites. You give Launch permission to store, copy, format, and display that material as needed to operate the Service and publish your sites. That permission ends when you delete the material or your account, apart from routine backups, which are cleared on a regular schedule.

You confirm that you have the right to use everything you publish, including photographs, logos, fonts, and endorsements, and that the people you name as endorsers have agreed to be named. If you upload a font file, you confirm that your license allows it to be used on a public website.

4. Rules that apply to political content

You are solely responsible for making sure your site complies with the laws that apply to you. These include federal, state, and local campaign finance law, required "Paid for by" disclaimers, fundraising rules, and the rules of any office or body you are subject to. Launch provides a place to enter a disclaimer but does not check whether it is correct or sufficient. Nothing in the Service is legal advice.

5. What you may not do

You may not use Launch to:

• Break the law, or help anyone else break it.
• Give false information about when, where, or how to vote, or about who is eligible to vote.
• Impersonate a person, campaign, organization, or government body, or build a site meant to be mistaken for someone else's.
• Threaten, harass, or incite violence against any person or group.
• Collect information from visitors by deception, or use visitor information in ways they were not told about.
• Distribute malware, send spam, or attempt to gain access to accounts or systems that are not yours.
• Interfere with the Service, overload it, or try to get around its limits.
• Infringe someone else's copyright, trademark, or other rights.

We may remove content or suspend a site that we reasonably believe breaks these rules. Where we can, we will tell you first and give you a chance to fix it. Where the harm is serious or urgent, we may act immediately.

6. Visitor information

If your site collects information from visitors, you are responsible for how you use it and for telling visitors what you will do with it. Launch stores that information on your behalf, as described in our Privacy Policy.

7. Outside services

Your site may link to or embed services run by others, such as donation platforms and video hosts. Those services have their own terms and their own privacy practices. Launch does not process donations and is not responsible for outside services.

8. Plans and payment

Current plans and prices are shown on our pricing page. During the pilot period the Service is provided without charge to invited users. When paid plans open, the price, billing period, and renewal and cancellation terms will be shown to you before you are charged, and those terms will become part of this agreement. We will give at least 30 days' notice of a price change that affects a plan you are paying for.

9. Addresses and domains

An address on getlaunchednow.com is provided for your use while your account is active and remains ours. We may reclaim an address that is misleading, infringing, or reserved. If you connect a domain you own, it stays yours.

10. Launch's property

The Launch builder, templates, software, name, and logo belong to Launch. You may use the templates to build your sites on Launch. You may not copy the software or resell the Service.

11. Ending the agreement

You can stop using Launch and ask us to delete your account at any time. We may suspend or end your access if you break these terms, or if we stop offering the Service. If we end the Service for reasons other than a breach, we will give you reasonable notice and a way to retrieve your content.

12. The Service is provided as is

Launch is new and is still being built. We work to keep it available and correct, but we provide it "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not promise that the Service will be uninterrupted or free of errors, or that your site will be available at any particular moment, including on or near an election day.

13. Limits on liability

To the fullest extent the law allows, Launch will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost votes, lost donations, lost profits, or lost data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim arose or one hundred dollars. Some states do not allow certain limits, so parts of this section may not apply to you.

14. Your responsibility to us

If someone brings a claim against Launch because of content you published, how you used visitor information, or your violation of these terms or of the law, you agree to cover the reasonable costs and damages that result.

15. Governing law

These terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in New Jersey, and you and Launch agree to the jurisdiction of those courts.

16. Changes to these terms

We may update these terms. If a change is significant, we will update the date at the top and notify customers by email before it takes effect. Continuing to use the Service after that date means you accept the updated terms.
